Colorado underage driving information

Underage DUI and UDD in Colorado

Colorado law uses separate categories for DUI, DWAI, and underage drinking and driving. An underage allegation may also involve a court case and a separate DMV licensing record.

Key facts

Age, the charged category, the alleged substance, the testing record, and the DMV history can place similar-looking incidents into different legal and administrative systems.

General public information

Official sources checked:

UDD is a distinct Colorado category

Colorado statutes identify underage drinking and driving as a separate category for drivers under twenty-one. The statutory definition and the records used in a particular matter determine whether UDD, DWAI, DUI, or another allegation is involved.

The label underage DUI is often used broadly in ordinary conversation. It does not establish the filed charge, the applicable standard, or the legal significance of a test result.

UDD, DWAI, and DUI are not interchangeable

Colorado's traffic code defines DUI, DWAI, DUI per se, and UDD separately. Each category has its own statutory language, and more than one allegation can appear in the same case record.

A citation, summons, chemical-test report, and final court disposition can use different terms. The filed record and governing law matter more than an informal description of the incident.

Court and DMV proceedings remain separate

The court addresses the filed case. Colorado DMV separately maintains the driving record and administers licensing action within its authority. The two systems can arise from the same event while applying different procedures and records.

A court outcome does not by itself state every licensing consequence, and a DMV action does not decide the criminal or traffic charge. Official notices identify the agency, case, and record involved.

Alcohol and drug allegations use different evidence

Colorado's statutory framework addresses alcohol, one or more drugs, or a combination of substances. UDD is an alcohol-related category, while other impairment allegations can involve different statutory provisions and evidence.

A laboratory result, officer observation, roadside investigation, and DMV record are different forms of information. No single general description determines how the evidence is treated in a particular case.

Age can connect several separate systems

Age-based licensing rules are separate from the law governing an alleged DUI, DWAI, or UDD.

The official court record and DMV driving record provide the starting point for understanding which systems are actually involved. This public page does not determine an individual's status in any of them.
