Colorado No-Insurance and Proof-of-Insurance Tickets
Colorado law treats coverage status, immediate evidence of coverage, and a separate DMV administrative notice as distinct issues. The charged subsection, alleged date and time, vehicle, driver, policy, and notice determine which statutory provisions may be involved.

Coverage and proof are separate questions
Colorado law separates operating without required coverage from failing to present immediate evidence. Section 42-4-1409(1) addresses an owner of a motor vehicle or low-power scooter required to be registered in Colorado who operates it, or permits it to be operated, on Colorado public highways without the required coverage. Subsection (2) addresses a person who operates a motor vehicle or low-power scooter on Colorado public highways without the required coverage. Subsection (3) addresses immediate evidence after a crash or specified lawful traffic contact.
Failure to present immediate evidence is prima facie evidence at trial of a subsection (1) or (2) violation, but it is not conclusive proof that no coverage existed. Subsection (6) says a person shall not be convicted under § 42-4-1409 if the person produces in court a bona fide complying policy or certificate that was in full force and effect at the alleged time. It separately permits the court clerk’s office to dismiss the charge after verifying that policy through Colorado’s Motorist Insurance Identification Database. Those statutory provisions describe distinct court procedures and do not establish the result of an individual case on this page.
The Colorado DMV states that its insurance database receives insurer updates at least weekly and that reporting or technical errors can occur. A database entry, policy record, and alleged date are distinct facts; none determines the result of an individual matter on this page. Coverage beginning after an alleged event does not establish coverage at an earlier time.

Published classifications and point schedule
Section 42-4-1409 classifies violations of subsections (1), (2), and (3) as class 1 misdemeanor traffic offenses. The section states a minimum mandatory fine of not less than $500 for a first conviction and not less than $1,000 for a second or subsequent conviction within five years. The statute contains additional terms that this page does not apply to an individual matter.
Colorado’s published point schedule lists four points for failure to maintain or show proof of insurance under § 42-4-1409. A schedule value is not a prediction of the points or other consequences in an individual matter; those depend on the conviction, disposition, reporting, driving record, and law in effect on the alleged date.

Court and Department of Revenue proceedings are separate
Section 42-2-127.7 describes a separate, notice-dependent Department of Revenue process after a Department determination that a driver operated without complying coverage. A proof-only allegation or court citation alone does not establish that the administrative process applies. The individual notice and current official agency information state any matter-specific requirements or dates.
A court disposition does not necessarily resolve a separate Department of Revenue proceeding, and an agency action does not necessarily dispose of the court case. This page does not determine whether either process applies, calculate a deadline, recommend a response, or predict an outcome.

What is the difference between having no insurance and not showing proof?
They are distinct statutory subjects. Section 42-4-1409(1) addresses an owner of a motor vehicle or low-power scooter required to be registered in Colorado who operates it, or permits it to be operated, on Colorado public highways without required coverage. Subsection (2) addresses a person who operates a motor vehicle or low-power scooter on Colorado public highways without required coverage. Subsection (3) addresses an owner’s or operator’s duty to present immediate evidence after a crash or specified lawful traffic contact.
Does Colorado recognize electronic proof of insurance?
Yes. Section 42-4-1409(3)(b) recognizes a policy or certificate presented through a phone or other electronic device as evidence of insurance. Electronic presentation and whether the policy was in force for the relevant vehicle and time are separate statutory subjects.
What does § 42-4-1409(6) say about coverage in force at the alleged time?
Section 42-4-1409(6) says a person shall not be convicted under the section if the person produces in court a bona fide complying policy or certificate that was in full force and effect at the alleged time. The same subsection separately permits the court clerk’s office to dismiss the charge after verifying the policy through the Motorist Insurance Identification Database. Those are distinct statutory procedures; this page does not determine whether either applies in an individual matter.
Are a court charge and a Department of Revenue action the same process?
No. Section 42-2-127.7 describes a separate, notice-dependent Department of Revenue process after a Department determination that a driver operated without complying coverage. A court charge and an administrative action can involve different notices, records, and legal questions. This page does not determine whether either process applies in an individual matter.
Consultation requests
The firm does not accept every type of matter. An appointment request allows the office to decide whether it may offer a consultation or accept the matter; it does not provide legal advice or guarantee representation or any outcome.
No attorney-client relationship. Viewing or interacting with this website, downloading a document, calling the office, or submitting a form does not create an attorney-client relationship. A relationship begins only if the firm accepts the matter, a written fee agreement is signed, and the required retainer is paid.
